TERMS OF SERVICE

1. Terms & Conditions
1.1 This site is owned and operated by The Unit Fitness and is the trading name of Foster Phelps Ltd, Unit 23 Roman Way Industrial Estate, Godmanchester, Cambs. PE292LN.
1.2 These terms and conditions include (i) general terms and conditions for the use of this site and (ii) terms and conditions relating to the services provided by The Unit Fitness on the site and in their fitness facility and use of the site, the purchase of any services on the site or use of the facility will be subject to these terms and conditions.

2. Membership Options/Bookings
2.1 Membership options are set out within the Memberships. Bookings for group fitness sessions may then be made through the Booking Software Timetable (TeamUp). Personal training session bookings have to be made with our Personal Trainers and are subject to their individual diaries.
2.2 Group training sessions and personal training sessions are always subject to availability, though we will do our best to accommodate you. There may be waitlists for Group Training sessions.  Trainers may change from those scheduled to lead a PT session or Group session and The Unit Fitness cannot guarantee any particular trainer will be available for any session. All membership options and group sessions must be prepaid and are subject to our cancellation policy below.
2.3 It is a condition of acceptance of membership that the member agrees to be bound by these terms and conditions.
2.4 The Unit Fitness reserves the right (i) to reject any application for membership without giving any prior notice or (ii) to cancel any membership without notice subject to 4.3 of these terms and conditions.
2.5 Membership is personal to the member and cannot be transferred.

3. Pricing
3.1 Information is displayed on our Memberships and Offerings pages. Pricing is subject to change by The Unit Fitness.

4. Code of Conduct
4.1 Members are expected to behave in an orderly fashion at all times whilst in the gym and shall be responsible for any injury they may cause to others and for any damage done to any property.
4.2 No alcohol may be brought by members into the gym and smoking is strictly forbidden anywhere on site. In addition, members may not enter the gym under the influence of alcohol or bring into the gymn any non-prescription drugs or illegal substances.
4.3 Failure by any member to comply with these terms and conditions including this code of conduct will entitle The Unit Fitness to terminate a member’s membership without refund.

5. Cancellation/Refund Policy
5.1 Payment for all sessions and group training must be made in accordance with the relevant Membership or PT package option and prior to any sessions booked and conducted.
5.2 Cancellations for any group sessions need to be made 2 hours before a class starts; any cancellation within 2 hours of any group session see that allocated session forfeited from the members allocation.

6. Suspension of service
6.1 the Unit Fitness will use their reasonable endeavours to ensure the gym is open and all equipment is in working order and available for use by members during such times as set out on our Timetable. There may be occasions, however, when the gym may be closed or a particular trainer may not be available for reasons beyond our control as, for example, for essential maintenance purposes or illness of the trainer.
6.2 The Unit Fitness may suspend the operation of this site from time to time.
6.3 The Unit Fitness reserves the right to reduce the number of sessions over Bank Holidays and the Christmas/New Year period.

7. Due care
7.1 Any training provided by The Unit Fitness will be carried out with all due care and attention.

8. Disclaimer of Liability
8.1 All members use the gym at their own risk. Neither The Unit Fitness nor its agents or employees shall be liable for;
8.1.1 the death or personal injury of any member whilst in or using the gym except to the extent that death or personal injury arises from any negligent act or omission of The Unit Fitness or any agent or employee thereof; or
8.1.2 any loss, damage to or theft of personal property belonging to the member occurring in the gym
8.2 It is all member’s responsibility to determine that they are fit and well before attending any sessions or group training and members are advised to undergo a medical examination prior to beginning any physical activity programme. In addition, all Members must complete a PAR-Q Form via the online booking software upon booking their first session or taking out a Membership package/program.

9. General
9.1 The Unit Fitness may change these terms and conditions from time to time and by browsing the site you are accepting that you are bound by the current terms and conditions which form the entire understanding of the parties and supersede any previous agreements, understanding and representations
9.2 These terms and conditions shall be governed by and interpreted in accordance with English law.

 

 

Open Gym Specific Terms

 

This membership will entitle the holding member attend The Unit Fitness Gym in Alconbury Weald during the gym opening hours stated on our website/booking schedule.

Classes/events may be excluded from this membership.  Unless otherwise noted, this membership is non-transferable. 

You may not pause a package whilst on holiday or ill.  Where circumstances mean you will be unable to train for a long period of time, we would need suitable proof in the form of a doctors/hospital letter to be able to your membership on hold.

 

Under no circumstances are you to let anyone else use your membership or any gym access keycards/fobs to gain unauthorised entry to the facility.  If your personal access keycard/fob is found to be being used by another person and has not been reported lost or stolen we reserve the right to confiscate the card and block your gym access until further investigation.  Any replacement cards will be subject to a £20 admin fee.

 

In order to use the gym you must be confident and competent to use the equipment safely without causing damage to the property or equipment or harm to yourself or other people within the facility.  Any improper use of the gym and it's equipment will be deemed a breach of contract and the Management will follow up with the appropriate actions.

We have security cameras in place with monitored access and usage by security staff to ensure the safety of our members.

 

On joining all members are offered a comprehensive induction to instruct you on the use of the gym equipment and The Unit Fitness will not accept any liability for any claim for personal injury if you use the gym equipment having not undertaken an induction from a qualified member of TUF staff.

Induction bookings can be made by contacting the TUF Team on joining.

 

If you are unsure as to how to use any piece of equipment you MUST seek advice from a qualified member of Gym staff before use such equipment.  The Unit Fitness and it’s staff will not be held liable for any injuries sustained if a proper induction has not been completed prior to use.

 

For safety reasons, bags are not permitted onto the gym floor and correct attire must be worn when exercising i.e. suitable comfortable exercise clothing and appropriate footwear. Clothing such as jeans, boots, flip-flops/sandals or work wear are not permitted. 

 

You may not use the gym whilst under the influence of alcohol, narcotics, tranquilisers or any medication or other substance which may affect your ability to exercise safely. TUF reserves the right to remove you from the premises if it reasonable believes you are unfit to use the facilities.

As a courtesy to other members, a small gym towel must be carried to wipe down equipment after use.

 

Can you ensure that you put your weights back in their original place when finished, repeated failure to do so may result in your membership being terminated.

Please do not misuse the weights by dropping them on the floor, failure to do so may result in your membership being terminated.

 

Please do not take photographs/videos on the premises or post remarks to the internet that may identify another member.

 

You must not behave in an aggressive, abusive, anti-social or threatening manner to any staff or member, any one doing so will have their membership terminated immediately and TUF reserves the right to contact the Police if deemed necessary.

 

Only TUF personal trainers are permitted to train members in the Gym. Anyone else undertaking members’ training will be asked to speak to Management.

Members are solely responsible for their own belongings whilst visiting The Unit Fitness and we accept no responsibility for any loss or damage to personal property.

Members are asked to only use the lockers for the duration of their training session. Lockers may be emptied at night and members items removed to lost property.

 

Although we will always endeavour to return any articles of lost property to the owner, we do not take responsibility for any item held in lost property. Such items will be kept until claimed, but for no longer than 4 weeks after which time the items will either be donated to charity or destroyed. 

 

Members must inform The Unit Fitness via email of any change of contact and email address or telephone numbers. These changes can also be made in the Members login area of the TUF Teamup booking system.

 

By accessing the gym and using the gym equipment members are deemed to have read and understood the terms and conditions of membership.

Should your Physical Activity Readiness Questionnaire result in you being required to discuss your intention to exercise with your doctor, please be aware that your subscription remains active and any fees collected are non-refundable.

 

Smoking, including e- cigarettes are strictly prohibited in all areas of the gym. Any member found to be breach of this rule may have their membership terminated.

Members may not bring any pets (other than official aid dogs) into the gym.

 

Members must arrive promptly for class start times, consistent late arrival may result in being refused entry to the class.

If you can’t make a class, please cancel it online or in our app. You may lose your booking rights if you forget to cancel on a regular basis.
